Modern India is a very strange place to live in. It ahs strange laws for governing the society and people are struggling against these outdated laws and the unscrupulous take advantage of the existing loop holes. The best example for this is the law for divorce. There are two sections in this .The Muslims and the Hindus. Though both sections have their own religious laws in this respect only the Muslim is allowed to follow the religious law’s of Islam and not others. This is supposed to have done in the name of grant of religious freedom to Muslims.
Does the constitution of India say so?
Leaving this aside, what about the divorce law for others?. It is very funny position. When one partner of a marriage does not want to live with the other and applies for divorce it should be straight away granted provided the divorcing partner does not make any clime of maintenance or property.(this is common sense) . But law has no common sense hence the court arranges reconciliation counseling which goes on for years. The plight or suffering of the party which has applied for divorce is no concern of the court, as such a procedure is prescribed under the law.
Divorce cases which can be easily settled drag on simply because one party does not want to let the other off the hook even by paying compensation. Probably the judiciary of India does not even have the statistics of the number of divorce cases pending in its courts and the length in number of years for which they are pending.
Thus judiciary becomes an indirect agent of mental torture to thousands of unfortunate people. Who cares? None!
